petty complaints To Be Politically Correct or Not to Be??

I moved into my new apartment in December of 2004. It is 150 square feet larger than my old place. This apartment has better location, new accessories, and it is $35 a month cheaper than my old one. The first month was free. At the time I thought this was a great deal. I went and signed the lease with the office manager, who was really nice. Then came the not surprising news. "The people that live above you are special. They can get a little loud from time to time. If that happens let me know," she says.
 
At the time, I didn't care. I was just happy with my new place. Not that it is super great, but it is a one bedroom place that is nice, for a reasonable amount of money. Within the first week, I knew why my place had new carpet, countertops, and a refrigerator when all the other units didn't.

You think your upstairs neighbors are loud? No, try a couple of 250 pound retarded women in their mid 30s, wrestling, screaming, and crying directly above you. They walk across the room and I am waiting for the plaster to fall from the ceiling. I didn't think it was possible to be this loud. They absolutely must stomp their feet every step they take. When my friends come over for the first time, they are absolutely amazed by how loud these two are.

Another fine surprise that came with my apartment is the 7am daily wrestling match directly above my room. Clearly, they are waking up at 7am and have nothing better to do than wrestle on the floor until one of them gets hurt and starts crying. Then it turns into a 45 minute screaming match.

So I call the office manager and she said that she would speak with the woman who cares for them. Clearly this has been an ongoing problem with other neighbors. The caretaker lives with them and is there most of the time. I don't believe she is related, but rather a live in nurse. She is overwhelmed with responsibility. Nothing changes....

This has been going on for 6 months now and I am almost ready to pay the fines and end my lease early. I am awoken at 7am about 3-4 times per week and the rest of the time they just stomp around, scream, and yell until it is time for bed. I have talked with the office manager 4 times and she really can't do much about it. I spoke with the caretaker 3 times and she can't get them to understand how to be quiet, or she doesn't care.

There are things in this world that are just out of your control and these two obviously can't control the way they are. I am not going to yell and scream at them. And I really feel bad even talking with the office manager about it. I feel bad complaining when they have been dealt such a tough hand in life, but god dam. THEY NEED TO SHUT THE FUCK UP.

At this point, I don't think the office manager can or will do shit about it, the caretaker has her hands full just trying to keep them from killing each other, and I don't have the 2 grand to end my lease and go elsewhere. Other neighbors complain to the caretaker, I am not the only one. But I am the only one that lives BELOW them. I almost never have anyone over, because I can't stand to be in my own home. I am basically fucked.

Should I be politically correct and keep my mouth shut when they don't mind singing their version of the national at the top of their lungs? Should I cut them a break and understand that they probably don't understand how loud they are and leave them alone? Or should I be a complete ass and complain as much as possible holding onto the slightest hope that maybe scaring them will help? Any path I take will be a painful one.

    and fuck paying $2000.00 to get out of the lease too. Depending on which state you live in, there are a few different ways to deal with shit like this. Do some research on tenant's rights for your area. A lease is a contract; it is binding to BOTH parties, not just you. Management's obligation to provide a habitable living environment is no less than your obligation to pay the rent. Would you have leased the place if the manager had used the description: persistently loud, potentially violent and out of control retards instead of misleading you? ("The people that live above you are special. They can get a little loud from time to time. If that happens let me know,") this feeble; "politically correct," non-disclosure means less than shit. ANYBODY can get a little loud from time to time. It sounds like you are dealing with this bullshit daily, not from time to time. You can bet yer ass that if you and your guests were loud drunks and the cause of these continual disturbances in the apartment complex you would have been evicted already. I don't want to sound unsympathetic to the plight of your neighbors but you didn't deal them the cards they are holding. At some point a determination must have been made that despite whatever their impairments; these 2 people are able function outside of an institutional setting. It's their wrangler's job to keep them in check and that is not happening. Regardless of what hour of the day, I would bitch at their keeper AND the manager AT ONCE every time these two impinge on your home life. If that didn't work, I would (as much as I'd hate to) start calling the cops on them for noise disturbances. Not with the expectation of any result but having verifiable evidence of management's ongoing failure to remedy the problem will come in handy in the civil action regarding the $2000.00 that you would be a fucking idiot to pay if you decide to move because of this shit.

      registered mail gets people's attention. Try that 3 or 4 times each. At the very least, you can show the receipts to your landlord and maybe get him to discount your rent. Call the cops too. Your landlord will see them outside the building sooner or later. If you keep calling them every time the tard wrangler loses controll of her tardlings, the landlord may start to get nervous that you're building a case against him. again, discounted rent.

        I actually agree with this; those people are paid by the gubment (usually) to make sure that they don't kill each other and help them live a real life-- if they are this dysfunctional, they should be separated, and probably be in a supervised home with more retards (retards are easier to wrangle in a herd).

        send registered mail to the landlord people, then send it to the wrangler, and finally to the social security administration (or whoever does disabled person care in your area).

        also, various areas have ways to complain about rentals, including governmental offices, and they can force the landlord to allow you out of the lease if they deem them as not keeping up their end of the bargain.

    Why the fuck aren't these fat retards on a bottom floor apartment?

    Are they incapable of climbing stairs, thus the higher floor keeps them from running away, or is the landlord of the building just as dense as they are?

    One more thing you can do to help your cause. I once asst. managed an apartment complex that dealt with section 8 (low-income) housing. Chances are that if the "special" women live there then your complex also deals with low income assisted housing. As long as the rules haven't changed since I did this you have the right to be transfered to another similar unit in the complex without a rent increase if you have a reasonable complaint and it sounds like you do. This apartment complex was in Colorado but I believe that the rules are across the board when it comes to government assisted rentals. The catch is that you pay another deposit when you transfer but as long as you didn't trash the old one you'll get it back as a credit. (This goes for ANYone: always do an anal-probe-like detailed walkthrough with your landlord before moving in and when moving out. Be there with your landlord BOTH times. Don't be shy about pointing out even the most nitpicky flaws in the rental before you move in and make sure the landlord signs a walk-through list of all defects. Don't let the landlord do the last walk-through without you present even if you are already moved out. You never know what strange damages can pop up in your absence. Your deposit can only be debited for things noted on the final walkthrough that you signed.) Even if this relocation doesn't happen it's great documentation for court to show that you did everything you could to work with the landlord.
